General terms and conditions for the use of the Pension and Disability Insurance Institute of Slovenia Website (Version 2.0)

General Provisions

The General Terms and Conditions regulate the use of data and online services on the website of the Pension and Disability Insurance Institute of Slovenia (hereinafter: ZPIZ) and the responsibilities of ZPIZ and the users.

The General Terms and Conditions are binding on all the users who access and use the data, documents and services provided on ZPIZ website. The General Terms and Conditions Document lays down the terms and conditions of use of the ZPIZ website content and represents a legally valid and binding agreement between ZPIZ and the users of ZPIZ portals.

 

Protection of Intellectual Property Rights

Pursuant to the Copyright and Related Rights Act, ZPIZ holds copyrights over the content protected by intellectual property rights such as graphic elements, photographs, illustrations, or other presentation texts, published on the ZPIZ website and all its constituent parts.

 

Purpose of Processing and Protection of Personal Data

ZPIZ undertakes to carefully protect the personal data of the website users. The data will be collected, obtained, stored, and processed exclusively to provide portal services, to improve the use of the website and for the purposes they were submitted for by the website users.

To improve the content and usability of its website, ZPIZ records certain non-personal statistical data on visitors’ accesses to determine the number of all accesses, the number of accesses to an individual website content, time distribution of accesses, average visit time, and similar.

The data is protected in accordance with the requirements of the law governing the protection of personal data.

ZPIZ undertakes to store the collected data only for as long as it is strictly necessary to achieve the purpose for which it was collected. The user provides the required personal data in the registration process. The user is obliged to ensure that their username and password will be used solely by themselves. Each user is independently responsible for the content they enter when logging in to the ZPIZ website. The user confirms that, prior to registration, they were duly informed of the scope and purpose of the processing of the personal data they provided during registration. Upon registration, the user gives their personal consent that ZPIZ may process the personal data they provided on the ZPIZ website.

ZPIZ undertakes not to use any personal data or contact information of users for any other purposes and not to disclose those to third parties without the express permission of the user, unless required so by the applicable law. While their personal data is being processed, an individual has the right to view, extract, copy, supplement, amend, block or delete their personal information in the database in accordance with the applicable law.

ZPIZ will protect the obtained data and prevent any misuse thereof. Personal data will be used exclusively for the purposes for which the user has given their consent.

 

General Terms and Conditions for the Use of ZPIZ Website

The ZPIZ website is intended for the user's personal use.

ZPIZ website and certain services provided on the website are available without registration.

Online services such as eZPIZ and BiZPIZ are available to registered users only. The registration is free of charge; however, in order to use online services, the users must confirm that they were acquainted with the General Terms and Conditions for the use of the ZPIZ online portals. Registration of others is not permitted, which is guaranteed by full liability for damages; in case of a dispute the user agrees to assume passive legitimation. The user must not authorise or register others under their account or to redirect user account. ZPIZ may, at its own discretion, refuse to assign a username that refers to another person, is protected by the rights arising from trademark laws or any other rights, is obscene, or otherwise unacceptable.

 

Terms of ZPIZ Website Use

By registering, logging in, or using the website, the user agrees to the General Terms and Conditions of Use. In failing to do so, registration or login shall not be possible.

Upon access and use the user undertakes to follow all the guidelines and other rules of use published on the ZPIZ website to ensure quality use of services.

 

 

 

 

Restrictions on Use

 

The user shall undertake:

 

  • Not to use the website for commercial gain, illegal purposes or any purposes other than those specified in these Terms of Use;
  • Not to distribute copyright–protected content or content from ZPIZ website;
  • Not to attempt to obtain, collect or store personal data of other users;
  • Not to copy, store or transmit all or any part of the ZPIZ website content;
  • Not to use computer codes, malware or any other programmes that could disrupt, disable or damage the ZPIZ website or services, its software and hardware, or telecommunication devices.  

 

ZPIZ shall reserve the right to deny access to the sites accessible by registration to users who violate the Terms of Use or act in contrary to those.

 

Disclaimer of Liability

ZPIZ is committed to ensure the accuracy and reliability of the content published on the ZPIZ website, as well as continuous operation and uninterrupted availability of the website. ZPIZ is not liable for any direct or indirect damage or inconvenience that may arise due to the functional failure of the website and/or services, technical difficulties in accessing the website content, or the inability to use online services. 

ZPIZ is not liable for any incorrect operation of the website and/or its services resulting from misuse or ignorance of the user. 

ZPIZ cannot guarantee the operation of the website or provision of services in the event of power outages or other technical disturbances that could temporarily disrupt the operation of the website or provision of services.

 

Disclaimer of Liability for External Sites not Owned by ZPIZ

ZPIZ is not liable for the form or content of websites that are in any way linked to ZPIZ website and are not owned or administered by ZPIZ. The liability of ZPIZ is excluded in all cases of visiting and use of such external links.

 

 

 

Website or Online Services Failure Due to System Malfunction or Maintenance

As a rule, the ZPIZ website is accessible 24 hours a day and all days in the year.

ZPIZ is committed to ensure continuous operation of the website and its services; however, it cannot rule out the possibility of system malfunction.

Due to troubleshooting and system maintenance, the ZPIZ website and its services may be subject to occasional planned operation interruptions (usually during weekends, holidays, and at night). During this time, the website and its services will not be available. Users will be notified of planned interruptions at least two days in advance.

ZPIZ cannot guarantee access to the website in the event of network or other failures, errors, technical disruptions or operation interruptions of third parties (power supply, etc.).

 

Website or Online Services Failure Due to Force Majeure

Force majeure is defined as any unforeseen and unexpected event that cannot prevented by website administrators and which affects the operation of the website and the services provided thereof.

In the event of force majeure, ZPIZ will not be responsible for the failure to fulfil any of its obligations or for any damage caused by reasons beyond its control.

 

Final Provisions

General Terms and Conditions shall enter into force on the day of their publication on the ZPIZ website.

By accessing the ZPIZ website the user acknowledges and accepts the terms named above.

ZPIZ may change The General Terms and Conditions at any time. The General Terms and Conditions are binding on users in any form changed.

ZPIZ will notify the users about any changes to The General Terms and Conditions on its website. Any disputes arising from violations of those shall be resolved by mutual agreement. If an agreement is not possible, the court in Ljubljana shall have the jurisdiction to resolve disputes.
